Vignette Terms of Use
1. Program Overview
Vignette is a program/app intended to assist users with curating and managing their art exhibit spaces.
2. Bugs and Limitations
2.1 Bugs
You acknowledge that Vignette is under development and may contain bugs or errors. We appreciate your patience and understanding as we work to improve the program.
2.2 Limitations
The features and functionalities of Vignette may be limited during the beta program.
3. Code and Intellectual Property
3.1 Confidentiality
The Vignette source code and underlying technology are considered confidential intellectual property of S Richard Shook Fine Art Studio.
3.2 Restrictions
You agree not to:
- Share, distribute, or copy the Vignette source code with anyone.
- Decipher, decompile, disassemble, or reverse engineer the Vignette source code.
- Modify, alter, or tamper with the Vignette code or program files.
- Remove or alter copyright information, meta tags, or any other identifying marks within the program.
4. Use of Vignette
4.1 License
You are granted a non-exclusive, non-transferable license to use Vignette within your designated exhibit venue space.
4.2 Additional Spaces
You may use Vignette in additional spaces (e.g., a client's home), but data associated with these spaces will have a different level of permanence compared to your primary exhibit space.
5. Cookies and Data
5.1 Cookies
Vignette and the associated website utilize cookies and small files to manage functionality. Your use of the program signifies your acceptance of these cookies.
5.2 Data Privacy
While efforts will be made to encrypt and protect your personal data (username and password), the spaces you create using Vignette are not considered private.
5.3 Data Sharing
You are not obligated to share your exhibit space or configurations publicly. However, you must grant access to the program developer for debugging purposes.
5.4 Third-Party Sharing
We will not share your personal information with any third parties. Encrypted data cannot be decrypted by the developer.
5.5 Lost Login Credentials
If you lose your username or password, you will need to request a reset. This may temporarily restrict your access to Vignette.
6. Community Galleries
6.1 Artist Access
In community galleries, artists may be granted access to specific spatial configurations for submitting or planning exhibits.
6.2 Artist Work Usage
Any artist work accessed will be used solely for program development and debugging purposes.
6.3 Copyright
No copyright privileges are granted for reproductions (physical or digital) beyond program diagnostics. Images used for diagnostics will be deleted or removed, with the original image retained in the database.
7. Updates and Support
7.1 Updates
While regular updates cannot be guaranteed, we will strive to improve Vignette based on user feedback.
7.2 Support
Instructions on how to use Vignette will be provided shortly.
8. Concerns and Feedback
We encourage you to share any concerns or feedback you may have regarding Vignette.
9. Disclaimer
The developer is not responsible for any images uploaded through the Vignette website. We do not mediate information beyond the schematic data you create and maintain within the program.
10. Suspension and Termination
Suspension will occur should your subscription be in default. There is a one week period to redeem your subscription status. In the event that your subscription remains suspended, the program will retain your data and images and display a static diagram.
If you decide to terminate your subscription data is retained but not displayed. You can redeem your subscription status by making a written request.
11. Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of the State of Iowa.
